Logo's & Wording on MHA Forms

Logo's & Wording on MHA Forms

We’ve been made aware of a number of incidents of Forms, both Thalamos and otherwise, not being accepted due to some wording & logo discrepancies on different types of Forms. These incidents have included:

  • MHLO Forms not being accepted due to the addition of “Form amended by SI 2020/1072 for use from 1 December 2020" on the bottom of the Form (Fig 1)

  • Thalamos Forms not being accepted due to the lack of “Form amended by SI 2020/1072 for use from 1 December 2020" on the bottom of the Form (Fig 1)

  • Forms not being accepted because the don’t have the DHSC logo on them. (Fig 2)

  • Forms not being accepted because they are white not pink. (Fig 1)

To be clear all of the above Forms are acceptable assuming the rest of the wording on the Form alignes with the Statutory Regulations, available here https://www.legislation.gov.uk/uksi/2020/1072/regulation/7/made

The Statutory Instrument makes no reference to colours, logo’s, or wording discussing the amendment itself.

It is our most critical concern that someone’s care will not be negatively impacted by a misinterpretation of the wording on one of our Forms. Hence, Thalamos work closely with the CQC and the DHSC to ensure you can have full confidence that our Forms are always compliant. Indeed the CQC are themselves a customer of Thalamos.

We would be happy to discuss this further with the AMHPs, MHA Legal Teams or Trust leaderships over a phone call or a meeting. Please feel free to contact us at 0203 886 0305 or support@thalamos.co.uk

Please note we are not lawyers, nor do we provide legal advice. For this reason, we encourage you to consult with your own advisors for legal advice on this matter.
